Hoda Rifai-Bashjawish has over a decade of expertise in navigating the intricacies of complex intellectual property litigation, adeptly handling large scale matters involving patent, trade secret, trademark, trade dress, copyright, and related contract and competition law. She also supports clients in managing and procuring intellectual property rights by prosecuting trademark and copyright applications, conducting M&A due diligence, negotiating transfer and license agreements, and preparing infringement and invalidity opinions. Hoda was named a 2023 New Leader of the Bar by the New Jersey Law Journal.
For over ten years, Hoda has honed her litigation skills across diverse platforms, from district courts nationwide and the Federal Circuit to the Patent Trial and Appeal Board (PTAB), the Trademark Trial and Appeal Board (TTAB), the International Trade Commission (ITC), and state courts in New York and New Jersey. She is well-versed in every facet of litigation, from pre-trial assessments to IPRs, motion practice, management of fact and expert discovery, and pre-trial motions.
Drawing from a dual technical background in biomedical engineering and physics, Hoda brings a nuanced understanding to her practice, covering a wide array of technologies such as medical devices, pharmaceuticals, IT/software, semiconductors, MEMS devices, optical lithography, telecommunications, camera systems, radio frequency transmission devices, and other electronic and mechanical systems.
Demonstrating a steadfast dedication to pro bono endeavors, Hoda has devoted over a decade to serving marginalized communities. Her pro bono initiatives encompass a diverse range of legal assistance, including representation at zoning board hearings, preparation of asylum applications, advocacy for indigent tenants in landlord-tenant court, support for domestic violence victims in family court, representation of a former inmate in prisoner’s rights matters, and volunteering at legal clinics. Notably, her contributions were recognized with the Pro Bono Service Award from the U.S. District Court for the Northern District of New York.
In addition to her pro bono work, Hoda served as an adjunct professor at the Syracuse Law Innovation Law Center and regularly speaks on a variety of issues involving intellectual property and legal practice.
